Prauda – Foreningen af uafhængige internetmedier: Høringssvar vedrørende Forslag til Europa-Parlamentets og Rådets direktiv om ophavsret på det digitale indre marked.
Prauda repræsenterer internetmedier, der tilbyder brugere indhold og lignende informationsdeling på en online platform. Vores formål er at bistå vores medlemmer og nye netmedier med at udvikle og udforske innovative mediemodeller og repræsentere medlemmerne og andre nye medier i spørgsmål, der kræver en fælles stemme. Denne høring giver os en vigtig mulighed for at give Kulturministeriet indblik i de vilkår vores medlemmer skaber nye journalistiske forretningsmodeller på samt reagere på den reform af ophavsretten, som EU-kommissionen lægger op til.
Vi fokuserer her særligt på forslagets artikel 11 om en ny rettighed for pressepublikationer. På trods af forslagets positive klang som en rettighed for medier, så er det tvivlsomt om det vil gavne udviklingen af nye medier og af udviklende digital journalistik. Vi frygter, at det formentligt vil skade vores mulighed for at drive digital, journalistisk forretning.
Forslaget til en ny rettighed lader til at være fremsat på forståelsen af, at internettet og især de store internetplatforme som Google og Facebook truer mediernes forretningsmodel og dermed eksistensgrundlag. Set fra de traditionelle mediers perspektiv nul-sums perspektiv kan der være en ræson i dette for dem, men set fra vores perspektiv er de store platforme på dette tidspunkt afgørende for vores mulighed for at hente trafik og vokse. Der er ingen tvivl om, at medier generelt skal blive bedre til at udvikle bæredygtige forretningsmodeller, men vi er stærkt skeptiske overfor, hvorvidt artikel 11 bidrager til dette – snarere det modsatte. Det kan aldrig være løsningen at barrikadere sig mod udviklingen og sætte hindringer op for, at internetbrugere kan finde vores indhold.
Artikel 11 om en ny rettighed for pressepublikationer
For os er det uklart, hvad denne nye rettighed for pressepublikationer reelt indebærer af konkrete tiltag, som den står skrevet. Denne usikkerhed samt de kritiske erfaringer fra lignende lovgivning i Tyskland og Spanien, som andre europæiske medier som fx Les Echos (F), The European (DE), og Die Zeit (DE) beskriver samt udtrykker i et fælles brev til Europa-kommissionen i 2015, er dog nok til, at vi kraftigt anmoder om aktiv dansk modstand mod dette forslag.
Hvadenten der reelt er tale om en link- eller snippetafgift, eller om medierne ligefrem aktivt skal give tilladelse til, at diverse platforme viser vej til vores indhold, som det nu ses i Tyskland, er det svært at se, hvordan forslagets ønske om at give medier større kontrol med deres indhold på internettet ikke snarere tjener til at afskære medierne fra internetbrugerne og dermed fra nye bæredygtige forretningsmodeller.
For vores medlemmer af mindre, internetbaserede medier har det særligt afskrækkende betydning, at erfaringerne fra Spanien og Tyskland viser, at den nye rettighed især gik udover trafikken til de mindre og mere ukendte medier, der er mere afhængige af, at deres indhold nemt kan deles og findes af nye brugere. Også vores medlemmer får langt størstedelen af deres brugertrafik fra internetplatforme som Facebook, Twitter og Google, hvor vi selv og vores brugere kan dele og finde artikler og således klikke sig ind på vores websider. Andelen af brugere, der aktivt selv går ind på vores sider som deres primære medier er stadig minimal, og derfor er vi afhængige af den trafik vi får fra sociale medier og platforme.
Med hensyn til behovet for øget kontrol af medieindhold stiller vi os også uforstående og kritiske over for, hvorvidt dette forslag opfinder et problem, der ikke findes. Allerede i dag giver blandt andet Robot Exclusion Protocol rig mulighed for, at medier kan undgå at få deres artikler indekseret af fx Google eller andre søgemaskiner. Man kan dels undlade at melde sin side til Google, men hvis man bare vil have undtaget enkelte artikler, indsætter man nemt et robot.txt i artiklens url.
Det svært at se, hvordan denne nye rettighed for pressepublikationer kan føre nogen fordele med sig – for mindre internetbaserede medier som os tyder den tværtimod til at have direkte negative konsekvenser, i og med den gør det langt sværere for os at tiltrække læsere og således bygge og dyrke nye, bæredygtige forretningsmodeller baseret på brugertrafik.
